Purpose of Sentencing

Section 718 of the Criminal Code Footnote 1 provides the purposes of sentencing. The section states the following: s. 718. The fundamental purpose of sentencing is to protect society and contribute, along with crime prevention initiatives, to respect for the law and the maintenance of a just, peaceful and safe society by imposing just sanctions that have one or more of the following objectives:

  1. to denounce unlawful conduct and the harm done to victims or to the community that is caused by unlawful conduct;
  2. to deter the offender and other persons from committing offences;
  3. to separate offenders from society, where necessary;
  4. to assist in rehabilitating offenders;
  5. to provide reparations for harm done to victims or to the community; and
  6. to promote a sense of responsibility in offenders, and acknowledgement of the harm done to victims or to the community.

The first change I would suggest would be right in the beginning of the purpose statement. The purpose of sentencing is very clear in the first part of the clause. The part that confuses me and grammatically seems awkward is the following: “to respect for the law and the maintenance of a just…” The wording does not make sense. I would suggest it be changed to: “to respect the law and the maintenance of a just…
