Audiences facultatives

17 (1) A public hearing may be held by a board in connection with any matter relating to its objects where the board is satisfied that such a hearing would be in the public interest.

(2) A public hearing shall be held by a board

  • (a) in connection with each application for a licence or for renewal of a licence;
  • (b) in connection with each application pursuant to section 27 for permission to enter on, use, occupy, take and acquire any lands or any interest therein; and
  • (c) where it is considering the amendment or cancellation of a licence.

(2) Doivent faire l’objet d’audiences publiques :

Exception

(3) Subsection (2) does not apply

  • (a) where the applicant in a case described in paragraph (2)(a) or (b), or the licensee in a case described in paragraph (2)(c), consents in writing to the disposition of the matter without a public hearing and, after publication of notice of a public hearing in connection with the matter pursuant to section 20, the board receives no notice within ten days prior to the date of the proposed hearing that any person intends to appear and make representations in connection with the matter; or
  • (b) where the board has under consideration the amendment of a licence, the board, with the consent of the Minister, declares the amendment to be required on an emergency basis.

(3) Le paragraphe (2) ne s’applique pas dans les circonstances suivantes :

  • a) l’auteur de la demande, dans le cas de l’alinéa (2)a) ou b), ou le titulaire du permis, dans le cas de l’alinéa (2)c), a accepté par écrit que l’office prenne sa décision sans audience publique, pourvu que personne, après la publication d’avis prévue à l’article 20, n’ait informé ce dernier, dans les dix jours précédant la date fixée pour l’audience, de son intention de comparaître et de présenter ses observations;
  • b) l’office, saisi de la modification d’un permis, déclare, avec le consentement du ministre, qu’elle s’impose d’urgence.

(4) A public hearing under this section shall be held at such place within … as the board considers appropriate and may be adjourned by the board from time to time and from place to place within Canada.

19 A board has, in respect of any public hearing under section 17, all the powers of a commissioner appointed under Part I of the Inquiries Act.

20 A board shall require an applicant for a licence, for the amendment or renewal of a licence or for authorization to assign a licence to give notice of the application by publication thereof in the Canada Gazette and in one or more newspapers, including at least one that is in circulation within the area affected, or in such other manner as the board considers appropriate, and the board shall itself give notice of a public hearing to be held by it by publication thereof in the Canada Gazette and in such other manner as it considers appropriate.

20 L’office exige que les auteurs de demandes de permis ou de modification, de renouvellement ou d’autorisation de cession de permis donnent avis de leurs demandes par publication dans la Gazette du Canada et dans un ou plusieurs journaux, dont au moins un diffusé dans la région concernée, ou par tout autre moyen qu’il estime indiqué. L’office donne lui-même avis des audiences qu’il se propose de tenir par publication dans la Gazette du Canada ou par tout autre moyen qu’il estime indiqué.

21 A board may make rules respecting

  • (a) its sittings;
  • (b) the procedure for making representations and complaints to it and in the conduct of hearings before it and generally the manner of conducting any business before it; and
  • (c) generally, the carrying on of its work, the management of its internal affairs and the duties of the officers and employees and the professional and technical advisers provided to it by the Minister.

21 L’office peut établir des règles régissant :

  • a) ses séances;
  • b) l’instruction des affaires dont il est saisi et, notamment, la procédure applicable à la présentation des observations et des plaintes et au déroulement des audiences;
  • c) d’une façon générale, la conduite de ses travaux, sa gestion interne et les attributions du personnel, des conseillers et des experts mis à sa disposition par le ministre.
