SÉRIE I
Release of seized articles
23 (1) An inspector shall release any article seized by the inspector under this Act when the inspector is satisfied that all the provisions of this Act and the regulations with respect thereto have been complied with.
23 (1) L’inspecteur, après avoir constaté que les dispositions de la présente loi et de ses règlements applicables à l’article qu’il a saisi en vertu de cette loi ont été respectées, donne mainlevée de la saisie.
Destruction sur consentement
(2) Where an inspector has seized an article under this Act and the owner thereof or the person in whose possession the article was at the time of seizure consents to the destruction thereof, the article is thereupon forfeited to Her Majesty and may be destroyed or otherwise disposed of as the Minister may direct.
(2) Le propriétaire ou le dernier possesseur de l’article saisi peut consentir à sa destruction. L’article est dès lors confisqué au profit de Sa Majesté et il peut en être disposé, notamment par destruction, conformément aux instructions du ministre.
Confiscation sur déclaration de culpabilité
(3) Where a person has been convicted of an offence against this Act or the regulations, the court or judge may order that any article by means of or in relation to which the offence was committed or anything of a similar nature belonging to or in the possession of the accused or found with the article, be forfeited, and on the making of the order the articles and things are forfeited to Her Majesty and may be disposed of as the Minister may direct.
(3) Sur déclaration de culpabilité de l’auteur d’une infraction à la présente loi ou à ses règlements, le tribunal ou le juge peut prononcer la confiscation, au profit de Sa Majesté, de l’article ayant servi ou ayant donné lieu à l’infraction, ainsi que des objets de nature comparable dont l’auteur est le propriétaire ou le possesseur ou qui ont été trouvés avec cet article. Il peut dès lors être disposé de l’article et des objets conformément aux instructions du ministre.
Ordonnance de confiscation
(4) Without prejudice to the operation of subsection (3), a judge of a superior, county or district court of the province in which any article was seized under this Act may, on the application of an inspector and on such notice to such persons as the judge directs, order that the article and anything of a similar nature found therewith be forfeited to Her Majesty to be disposed of as the Minister may direct, if the judge finds, after making such inquiry as the judge considers necessary, that the article is one by means of or in relation to which an offence against any of the provisions of this Act or the regulations was committed.
(4) Sans préjudice du paragraphe (3), le juge d’une cour supérieure, d’une cour de comté ou d’une cour de district de la province où l’article a été saisi en application de la présente loi peut, à la demande de l’inspecteur, ordonner que soient confisqués au profit de Sa Majesté l’article et les objets de nature comparable trouvés avec cet article et qu’il en soit disposé conformément aux instructions du ministre. Cette ordonnance est subordonnée à la transmission du préavis prescrit par le juge aux personnes qu’il désigne et à la constatation par ce dernier, à l’issue de l’enquête qu’il estime nécessaire, du fait que l’article a servi ou a donné lieu à une infraction à la présente loi ou à ses règlements.
SÉRIE II
Confiscation sur consentement
13 (1) Where an inspector has seized any substance or product pursuant to subsection 11(1) and the owner thereof or the person in lawful possession thereof at the time of seizure consents in writing at the request of the inspector to the forfeiture of the substance or product, the substance or product is thereupon forfeited to Her Majesty.
13 (1) Le propriétaire ou le dernier possesseur légitime de la substance ou du produit saisis par l’inspecteur en application du paragraphe 11(1) peut consentir, par écrit, à leur confiscation. Le cas échéant, la confiscation s’opère immédiatement au profit de Sa Majesté.

(2) Where a person is convicted of an offence under this Act and any substance or product seized pursuant to subsection 11(1) by means of or in relation to which the offence was committed is then being detained, the substance or product
(2) La substance ou le produit qui, ayant servi ou donné lieu à la perpétration d’une infraction à la présente loi, ont été saisis en application du paragraphe 11(1) et se trouvent en rétention au moment où l’auteur de l’infraction est déclaré coupable :
(a) is, on the conviction, in addition to any punishment imposed for the offence, forfeited to Her Majesty if the forfeiture is directed by the court; or
a) sont, sur cette déclaration de culpabilité et en sus de toute autre peine infligée, confisqués au profit de Sa Majesté si le tribunal l’ordonne;
(b) shall, on the expiration of the time for taking an appeal from the conviction or on the final conclusion of the proceedings, as the case may be, be restored to the person from whom it was seized or to any other person entitled to possession thereof on such conditions, if any, as may be imposed by order of the court and as, in the opinion of the court, are necessary to avoid the commission of any further offence under this Act.
b) sont, à défaut de confiscation et à l’expiration du délai d’appel prévu ou, en cas d’appel, une fois que l’affaire est tranchée, restitués au saisi ou remis à leur possesseur légitime; la restitution ou la remise peut s’assortir des conditions, précisées dans l’ordonnance du tribunal, que celui-ci estime nécessaires pour que soit évitée la perpétration de toute nouvelle infraction à la présente loi [… évitée toute récidive].
