NOVA SCOTIA JUDICIAL APPOINTMENTS ANNOUNCED

OTTAWA, October 2, 2013 – The Honourable Peter MacKay, P.C., Q.C., M.P. for Central Nova, Minister of Justice and Attorney General of Canada, today announced the following appointment:

The Honourable Mr. Justice J. Edward Scanlan, a judge of the Supreme Court of Nova Scotia (Truro), is appointed a judge of the Court of Appeal of Nova Scotia, to replace Madam Justice M.J. Hamilton, who elected to become a supernumerary judge as of November 11, 2012.

Mr. Justice Scanlan was appointed to the Supreme Court of Nova Scotia in 1993. Prior to his appointment, he practised law with the firm Scanlan Graham Scanlan in Pictou.

Mr. Justice Scanlan received a Bachelor of Arts from St. Francis Xavier University in 1977, and a Bachelor of Laws from the University of New Brunswick in 1980. He was admitted to the Nova Scotia Barristers’ Society in 1980 and appointed Queen’s Counsel in 1992.

Mr. Justice Scanlan is a former chair of the Regional Assessment Appeal Court for Pictou County and a Nova Scotia Small Claims Court adjudicator. He was also a chair of the Pictou Waterfront Development Corporation.

The Honourable Elizabeth Van den Eynden, a lawyer with MacIntosh, MacDonnell & MacDonald in New Glasgow, is appointed a judge of the Supreme Court of Nova Scotia (Truro), to replace Mr. Justice J.E. Scanlan, who was appointed to the Court of Appeal of Nova Scotia.

Madam Justice Van den Eynden received a Bachelor of Arts in 1984 from St. Francis Xavier University, and a Bachelor of Laws from the University of New Brunswick in 1987. She was called to the Nova Scotia Barristers’ Society in 1988 and was appointed Queen’s Counsel in 2008.

Madam Justice Van den Eynden joined MacIntosh, MacDonnell & MacDonald in 1988 and became a partner in 2009. Her main practice areas were labour law, employment law, civil litigation, and child protection.

Madam Justice Van den Eynden is a member of the Canadian Bar Association, Atlantic Provinces Trial Lawyers’ Association and the Canadian Association for the Practical Study of Law and Education. She is a member of several committees of the Nova Scotia Barristers’ Society and a member and former president of the Pictou County Barristers’ Society.

The Honourable Joshua M. Arnold, a lawyer with Arnold Pizzo McKiggan in Halifax, is appointed a judge of the Supreme Court of Nova Scotia, to replace Mr. Justice R.W. Wright, who elected to become a supernumerary judge as of June 30, 2013.

Mr. Justice Arnold received a Bachelor of Arts from Acadia University in 1986, and a Bachelor of Laws in 1989 from Dalhousie Law School. He was admitted to the Nova Scotia Barristers’ Society in 1990, and appointed Queen’s Counsel in 2009.

Mr. Justice Arnold has practised with Arnold Pizzo McKiggan since 1996. Prior to that, he was a lawyer with Scarvelli and Associates from 1995 to 1996. He was Crown attorney for the Public Prosecution Service of Nova Scotia from 1992 to 1995, and practised with Crosby Murtha in Sackville, N.S., from 1990 to 1992. His main area of practice was criminal law.

Mr. Justice Arnold has been a member of the National Association of Criminal Defence Lawyers (US) since 2012 and a member of the Canadian Bar Association since 2005. He was an organizing member for the Annual Fall Criminal Law Conference from 2004 to 2012. He has also served as president of the Nova Scotia Criminal Lawyers Association since 2009.

The Honourable James L. Chipman, a lawyer with Stewart McKelvey in Halifax, is appointed a judge of the Supreme Court of Nova Scotia, to replace Madam Justice M.H. Robertson, who elected to become a supernumerary judge as of July 1, 2013.

Mr. Justice Chipman received a Bachelor of Arts in 1981 and a Bachelor of Education in 1982 from Acadia University. He obtained a Bachelor of Laws from Dalhousie Law School in 1991. He was admitted to the Nova Scotia Barristers’ Society in 1992 and appointed Queen’s Counsel in 2008.

Mr. Justice Chipman joined Stewart McKelvey in 1998 and became a partner in 2000.  Prior to that, he was an associate with Cox Downie from 1992 to 1998. His main practice areas were civil litigation, insurance law, health law, and dispute resolution.

Mr. Justice Chipman has been a member of the Nova Scotia Legal Aid Commission Board since 2002. He is also a member of the Nova Scotia Medical Legal Society, the Association of Defence Trial Lawyers, the Defence Research Institute and the Canadian Bar Association. He is the recipient of a LexisNexis Martindale-Hubbell Peer Review rating, was recognized as a “Top Lawyer” for personal injury litigation in Nova Scotia and was selected by his peers to be included in the 2008 to 2011 editions of the Best Lawyers in Canada. He was board chair for the Regional Residential Services Society from 2007 to 2009, and for the Provincial Autism Centre from 2005 to 2010.

The Honourable Robin Gogan, a lawyer with The Breton Law Group in Sydney, is appointed a judge of the Supreme Court of Nova Scotia, to replace Madam Justice C. Bourgeois, who was transferred to Halifax.

Madam Justice Gogan received a Bachelor of Arts from St. Francis Xavier University in 1991 and Bachelor of Laws from Dalhousie Law School in 1994. She was admitted to the Nova Scotia Barristers’ Society in 1995.

Madam Justice Gogan has served as managing partner with The Breton Law Group since 2011. She was a partner with Sampson McDougall from 2002 to 2011, and an associate with Anderson Nathanson from 1995 to 1998. Her main practice areas were civil litigation, family law, wills and estates, mediation, and alternative dispute resolution.

Madam Justice Gogan has been a member of the Cape Breton Barristers’ Society since 1994, the Canadian Bar Association since 1995, the Canadian Petroleum Foundation since 2002, the Atlantic Provinces Trial Lawyers Association since 2002, and the Association of Trial Lawyers of America since 2002. She was a member of Family Mediation Canada and the ADR Institute of Canada from 2001 to 2007. She is the author of several papers and was a guest speaker for a variety of groups and organizations.

These appointments are effective immediately.
