II. The mandate

Our mandate for this Investigation has been set out below:

  1. Conduct a fact-finding exercise into whether or not the newly appointed Chief Commissioner of the CHRC, Mr. Dattani, has made comments and engaged in conduct as alleged and reported in the media in June and July, 2024 (the “Media Reports”). The fact-finding exercise should also consider whether or not Mr. Dattani (even if not in the Media Reports) has made other similar comments and/or engaged in similar conduct.
  2. During the fact-finding exercise, conduct interviews and review material as the fact-finder deems appropriate.
  3. If a conclusion is made that any comments or conduct as alleged in the Media Reports (or other similar comments or conduct) occurred, the fact-finding exercise should also consider the surrounding circumstances in which those comments were made and/or conduct occurred.
  4. If it is concluded that any of the alleged comments or conduct (or other similar comments or conduct) occurred, did Mr. Dattani disclose such comments or conduct in the application and/or interview process.
  5. Upon the completion of the fact-finding exercise provide a report of factual findings, which can be publicly disclosed (the “Report”).

Our mandate did not include a review of the policies or procedures in respect of vetting candidates being considered for Governor in Council (“GIC”) positions and/or GIC appointees generally, or what was done in the case of Mr. Dattani’s recent appointment.
