Judges Act, Federal Courts Act, and Tax Court of Canada Act amendments

Division 27 of Part 4 amends the Judges Act, the Federal Courts Act, and the Tax Court of Canada Act to add a total of 13 new superior court judicial positions: one new associate chief justice for the Supreme Court of Newfoundland and Labrador – Trial Division; one new judge for the Federal Court of Appeal; five new judges for the Ontario Superior Court of Justice; two new judges for the British Columbia Supreme Court; two new judges for the Saskatchewan Court of Queen’s Bench; and two new judges for the Tax Court of Canada.

The new judicial positions will respond to existing and projected workload pressures and assist the courts in dealing with their caseloads in a timely manner.

Issue

These amendments authorize the salary for a new Associate Chief Justice for the Supreme Court of Newfoundland and Labrador – Trial Division, as well as salaries for five new judges for the Ontario Superior Court of Justice; two for the Supreme Court of British Columbia; and two for the Court of Queen’s Bench for Saskatchewan. They also increase the complement of the Federal Court of Appeal by one judge, and the Tax Court of Canada by two judges.

Clause 255

This clause amends subsection 5(1) of the Federal Courts Act to increase the complement of the Federal Court of Appeal by one judge.

Clause 256

This clause amends paragraph 12(d) of the Judges Act to increase the complement of the Ontario Superior Court of Justice by five judges.

This clause amends the French version of subsection 4(1) and the English version of paragraph 4(1)(c) of the Tax Court of Canada Act to increase the complement of the Tax Court of Canada by two judges.
